Kochi: The Supreme Court on Wednesday ruled that former Kerala Chief Minister Pinarayi Vijayan, his daughter Veena T. and son-in-law Muhammad Riyas, a former Minister, could appeal before a Division Bench of the Kerala High Court against a Single Bench order directing the registration of an FIR in the CMRL-Exalogic payoff case.

Following the High Court’s direction, the Kerala Vigilance and Anti-Corruption Bureau (VACB) registered an FIR and initiated an investigation into the allegations against Vijayan, Veena and Riyas. The Supreme Court subsequently stayed the probe for seven days.

The Supreme Court said investigations under the Prevention of Corruption Act must be conducted in accordance with the law. Justice Joymalya Bagchi pointed out shortcomings in the High Court’s approach and noted that the Single Bench order contained contradictory observations. The Supreme Court also cautioned the ED against exceeding its jurisdiction.

Vijayan, Veena, Riyas had approached the Supreme Court challenging the Single Bench order directing the Vigilance and Anti-Corruption Bureau to register a case. The Supreme Court constituted a special Bench to hear their petitions. The Bench comprised Justices Joymalya Bagchi and V. Mohana.
