Supreme Court Declines to Interfere in ECI Transfers of Officials

Delhi: The Supreme Court on Thursday refused to intervene in the Election Commission of India’s (ECI) decision to transfer senior bureaucrats and police officers in West Bengal ahead of the Assembly elections.

A Bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi, and Justice Vipul M. Pancholi noted that such transfers are a routine administrative practice during elections across the country and found no grounds to step in at this stage, especially with the polls approaching.

The plea, filed by Advocate Arka Kumar Nag, challenged the large-scale transfer of key officials, including the Chief Secretary, Director General of Police, Home Secretary, District Magistrates, and Superintendents of Police.

Appearing for the petitioner, Senior Advocate Kalyan Banerjee argued that the transfers were carried out in violation of the Representation of the People Act, 1951, and without the required consultation with the state government.
